Ayuda, Vaca Daffan share guidance as fraudulent “attorneys” adopt increasingly complex schemes

Washington, D.C. (October 19, 2026) – In response to an alarming rise in predatory immigration legal scams, Ayuda and Vaca Daffan Law released a video with updated guidance to help immigrant families identify and avoid legal services fraud.

According to reporting from ProPublica, formal complaints of immigration legal services scams have doubled since Trump was elected, with tens of millions of dollars systematically siphoned from immigrant communities annually. Captioned in our region’s top languages — Spanish, French, Dari, Amharic, and Haitian Creole — the new video equips immigrant communities disproportionately targeted by fraudsters, as well as the wider public, with practical tips for finding a qualified immigration attorney.

“Given rapidly changing immigration policies and the heightened presence of immigration enforcement, many immigrants are living somewhere in between fear and desperation in this moment,” said Sarah Martin, supervising immigration attorney for Ayuda’s Project END program. “These are the conditions in which fraud thrives. Even worse, new AI technologies that allow scammers to impersonate real attorneys or host a fake virtual hearing before a judge can make it even harder to spot the signs of fraud before it’s too late.”

For immigrants who fall prey to immigration legal services fraud, the consequences can range from damage to their legal case to financial ruin to permanent family separation. In the case of an Ayuda client who anonymously shares her story in the video, she had paid $20,000 by the time she discovered that the money was lost to a scammer.

“Families of detained or deported immigrants are often losing the breadwinner of their family. That means they are living a financial catastrophe at the same time as an immigration catastrophe,” said Monica Vaca, founding partner of Vaca Daffan Law. “Scammers are pros at taking advantage of this desperate situation. But if we spread the word, we can help people avoid scams and look for help in the right places.”

To protect against these evolving tactics, Ayuda and Vaca Daffan outline some red flags:

  • Social media is the wrong place to find an immigration lawyer. To find a lawyer, visit a respected source, like the American Immigration Lawyers Association’s Find a Lawyer Tool.
  • Guarantees and “fast-track” promises are not true: Legitimate practitioners cannot promise or guarantee outcomes or timelines.
  • There is no contract in writing: A licensed attorney will always provide a formal, written contract detailing services and fee structures.
  • Payment is demanded by gift card, wire transfer, or online money app: Legitimate attorneys will not insist solely on non-refundable methods like Zelle, Venmo, or CashApp.
  • Blank documents should never be signed. If you are given a form to fill in a language that you don’t understand, always ask for a translated document.
  • Requests to misrepresent facts: Qualified counsel will never ask you to submit false information or fabricate claims to the U.S. government.

Immigration legal advice or representation is one of the best ways that immigrants can shield themselves during this moment of uncertainty – but only if it’s qualified.
